The opinion of the court was delivered by The question presented by these consolidated appeals is รข€” Who is entitled to hold the office of Workmen's Compensation Director of the state of Kansas? On April 13, 1959, Governor Docking appointed Elmer J. Schumacher to the office of Workmen's Compensation Commissioner, effective May 10, 1959, for a four-year term. The appointment was made under the authority of ร§ 16, ch. 250, Laws of 1955, appearing as G.S. 1959 Supp., 74-710, the pertinent part of which reads: ""There is hereby created the office of workmen's compensation commissioner. The workmen's compensation commissioner shall receive an annual salary of eight thousand dollars ($8,000) and, upon the expiration of the term of office running at the taking effect of this act, shall be appointed by the governor for a term of four (4) years, and he shall before his appointment have had a practical knowledge of the theory of workmen's compensation. Upon the expiration of the term as aforesaid each succeeding workmen's compensation commissioner shall be appointed and shall hold [the] office for a term of four (4) years and until his successor shall have been appointed and qualified. . . .""
